Cancellation of registration of foreign trade operators

On December 30, 2022, the Standing Committee of the National People's Congress adopted the Decision to Amend the Foreign Trade Law of the People's Republic of China (adopted at the 38th Meeting of the Standing Committee of the 13th National People's Congress on December 30, 2022).

The draft deleted the provision in Article 9 of the Foreign Trade Law that "Foreign trade operators engaged in the import and export of goods or technology shall register with the foreign trade department of the State Council or its authorized institutions; however, laws, administrative regulations and the foreign trade department of the State Council do not require registration. The specific methods for registration shall be prescribed by the foreign trade department of the State Council. If foreign trade operators fail to register in accordance with the regulations, the customs will not handle the customs clearance procedures for import and export goods."

According to the decision, local commerce authorities will stop processing foreign trade operator filings from December 30, 2022. For market entities applying for import and export licenses, technology import and export contract registration certificates, quotas, state-owned trade qualifications and other relevant certificates and qualifications, relevant departments will no longer require them to provide foreign trade operator filing materials.

Enterprises (trading companies) engaged in import and export business no longer need to go to the Ministry of Commerce to go through the registration procedures for foreign trade operators (Note: those who ship goods on their own behalf or declare customs independently still need to go through the customs consignee and consignor registration. If export enterprises need tax refunds, they still need to go through the tax refund qualification registration).
